User Agreement
1. Purpose
Imhonet provides its Services (functionality and content) subject to the terms and conditions specified in this User Agreement (hereinafter referred to as the “Agreement” or “UA”). By registering on http://imhonet.ru the User agrees to the terms and conditions of this Agreement. The Imhonet Administration reserves the right to change this Agreement without special notification; the revised UA is effective within 3 (three) days from its posting, unless otherwise stated in the revised Agreement.
2. Description of Services
Imhonet provides a range of online services, including but not limited to navigation and communication tools, content, and making purchases. Any existing options or development and/or addition of new options are the subject of this Agreement. By registering on http://imhonet.ru the User accepts that the services are provided on an "as is" basis, and acknowledges that Imhonet provides high-quality services to the best of its ability and for this takes all reasonable measures. All the while Imhonet is not liable for any delays, failure, inaccurate or untimely delivery of information, loss of any user personal information arising out of any telecommunication or energy system failure, software viruses, unethical (or inexpert) practices of third parties, resulting in failure of software and/or hardware, as other factors.
Imhonet advises that due to technology of the Service your content may be required to be transferred via computer networks or altered to comply with technical specifications of system.
Imhonet makes no warranties for accuracy, integrity and quality of the content transferred via its services provided that not all of the content is developed by the Service. Users shall individually assess risks related to the exploitation of the content, including assessment of its accuracy, integrity and value. Imhonet is not liable for the user generated content, even though it hurts someone’s feelings or appears disputable. Users shall know that they are responsible for the content (information, data, text, software, music, images, graphics, video, messages, etc.) they post to the public, send privately or make available to third parties or otherwise on Imhonet.
Be advised, that a number of Imhonet services may contain “adults only” information. The Service provides protection from free transitions from child profiles to adult profiles, users under 18 years of age shall individually withhold access to such information.
Imhonet does not bring under strict control and liability user generated content, nonetheless it reserves the right to discard or remove any content which conflicts with ideology of Imhonet or is inconsistent with the terms and conditions of this Agreement.
3. Registered User Obligations
The User is responsible for personal information it provided at registration and shall keep such information up-to-date. Shall information provided by the User be provocative or conflict with the Service ideology, the administration has the right to suspend or cancel the User registration or deny the User access to the website in whole or in part.
When registration is complete, the User is provided with the login and password and access to main website functionality which requires user identification to generate and specify user profile and give recommendations.
Registered User obtains the login and password to access Imhonet services. The User is liable for any actions executed under the user’s login and password.
Imhonet has the right to inhibit the use of certain logins and/or withdraw such logins from usage whether they violate right of other sides or are not in compliance with this Agreement, or words and terms of common use are used as logins, or projects having the same names are developed on Imhonet. In case the login is withdrawn subject to a new Imhonet project, administration shall save user data under other login.
If user discovers unauthorized (i.e. not authorized by the User) attempts to access Imhonet services with the User’s login and password and/or other disturbance of the User’s private space, the User shall immediately inform the Imhonet administration about any and all such cases.
The User independently logs out under its ac“Exit” button|length after any session. Imhonet is not liable for any possible loss or damage of data, resulting from any breach of this clause of the UA.
Imhonet is not responsible for any agreements made between the User and third parties.
4. Registered User Policy
Information provided by Imhonet is secured by laws of the Russian Federation and international copyright agreements made by the Russian Federation. The User agrees to comply with all applicable copyright laws and not to transgress restrictions imposed by laws on its actions. The User shall not: reproduce, copy, modify (edit), sell/resell, or otherwise commercially exploit the Content and/or functionality of Imhonet, except as the expressed approval of the administration of Imhonet.
Exploitation of the functionality of Imhonet is prohibited for:
- posting any content that breaches someone’s moral and ethical standards, or hurts religious or national feelings, or promulgates enmity, hatred, discrimination, or insults individuals or organizations, or is illegal, threatening, slanderous;
- violation of laws of underage individuals and/or civil injury in any form;
- impairment of rights of minorities;
- false personation or representation of any organization and/or community, including Imhonet personnel, moderators or owners of the website; or mispresentation of any individuals or subjects;
- posting (anywise) any content unauthorized for disclosure according to the laws of the Russian Federation or any other contractual documents;
- posting (anywise) any content secured by any patent, trademark, commercial secret, copyright and related rights of third parties, or other propriety rights;
- posting (anywise) any unauthorized promotional information, spam (including spamdexing), lists of e-mail addresses of others, pyramid schemes, Multi-Level Marketing (MLM), systems of Internet earnings and e-mail businesses. Exploitation of any similar schemes (sending unsolicited emails with links to Imhonet provided services, including email addresses, websites, bookmarks, etc). These schemes are prohibited even if the sending was made without the direct use of mail servers of Imhonet;
- posting (anywise) any malicious software and/or materials that contain viruses or other computer codes designed to interrupt, destroy or limit the functionality of Imhonet or any other computer or telecommunication equipment; programs for unauthorized access, serial numbers for commercial software products, as well as software for their generation. Usernames, passwords and other means for unauthorized access to paid resources on the Internet. As well as posting links to above specified information;
- violation of local, Russian laws or international laws, as well as posting links to Internet resources, whose content is contrary to applicable local legislation of the Russian Federation;
- collecting and storing personal data of other individuals;
- impairment of work of Imhonet website;
- use of any forms and methods of illegal representation of others on the Internet;
- promote actions aimed at violation of this Agreement.
5. Terms of Functionality Use and Data Storage
Imhonet may impose limitations on the use of its functionality. The Administration of the service may send information messages to users, and also reserves the right to remove those user accounts that did not use its access for 1 year. Imhonet may change the rules and restrictions with or without prior notice.
Imhonet may close any of its services or sections with or without prior notice. Imhonet is not responsible for blocked entry to its services if it results for reasons beyond the control of the administration.
The User confers Imhonet the right to use information posted with open access on Imhonet (reviews, comments, blog entries, etc.) for public purposes with the obligatory copyright notices.
6. Links
Imhonet services may contain links to other resources. Imhonet is not responsible for availability or content of these resources and any consequences arising from the use of this content.
7. Imhonet Ownership
Imhonet functionality and software are protected by intellectual property laws and other Russian and international documents. Laws of copyright, trademarks and patents also cover the content of the website. Modification, sale and distribution of the content and software (in whole or in parts) are not allowed, except as otherwise expressly stipulated by the Imhonet administration.
Imhonet provides the User with a private non-exclusive right to use its software on the User’s personal computer, provided that neither the User nor any other persons in association with the User will not copy or modify software, create derivative software, get into software in order to obtain codes; sell, assign, lease, transfer to third parties the rights to the software; and to modify Imhonet Services, including for the purpose of obtaining unauthorized access to them.
8. Idemnity
The Imhonet Services are provided on an "as is" basis, and are used by the User at his own convenience. Imhonet is not liable for the way the User exploits them (including for the compliance of the Service to the User’s purposes).
Imhonet provides high-quality services to the best of its ability. Coincidentally, please, be advised that there are a number of reasons beyond the control of the efforts and intentions of the administration, the service can not guarantee that:
the service will meet the User’s requirements, be uninterrupted, timely or error free; and the results obtained with the use of services will be absolutely accurate; the quality of any product, service, information, etc. will match the User's expectations; and all errors in the software and content will be corrected;
The User is responsible for any damage to the User’s computer and/or User data resulting from downloading materials with the use of Imhonet services. Imhonet does not guarantee the safety of these materials;
Imhonet is not responsible for any losses resulting from: improper use of or inability to use the service; unauthorized access to the User’s communications; statements or behavior of any third party on Imhonet website.
Imhonet.ru is publicly available resource and operates in compliance with all applicable laws of the Russian Federation. The administration of the resource is not liable information posted by the Users on imhonet.ru. If you are the holder of exclusive intellectual property rights for any objects posted to imhonet.ru, and your rights in any way are violated by the use of this resource, please notify the support team via the feedback form. Your message will be necessarily considered; you will receive the message with the results of actions with respect to the alleged violation of your rights.
9. General Information
The Agreement shall enter into force upon registration and is valid for the lifetime of Imhonet.
10. General Information
10.1. The User Agreement is a binding contract between the User and Imhonet and regulates the actions of the User on imhonet.ru.
10.2. Any possible disputes over the User Agreement shall be resolved in accordance with applicable rules of laws of the Russian Federation.
10.3. In view of the gratuitous services provided under the User Agreement, the rules on the protection of consumer rights are not applicable. If the Terms of Service will be given refundable nature, supplemental agreements will be published for each service.
10.4. Nothing in the User Agreement can be understood and interpreted as the establishment between the User and Imhonet of agency relationship, partnership relations on joint activities, employment relationships, any other relationship, not expressly provided herein.
10.5. Judicial acceptance of any provision of the UA as invalid or unenforceable does not entail invalidation of other provisions of the Agreement.
10.6. In case of violation of the provisions of the User Agreement by the User or other Users, inaction of Imhonet does not disable Imhonet to take appropriate actions later to protect its interests; neither it is deemed as a waiver of its rights in case of similar violations in future.
